In the process of Central Community Legal Service providing services
to you, we may need to collect personal information about you.
Personal information is information from which you could be identified.
Some examples are
Central Community Legal Service, as a part of UnitingCare Wesley
Adelaide, follows the guidelines set by the Ten National Privacy Principles
when managing all records and information, including the collection of
personal information.
Confidentiality
As we are a legal service, we have a heightened responsibility of confidentiality.
Anything that you discuss with a lawyer will remain confidential within
the service, and will not be disclosed to or discussed with a third party
without your consent.
Your file is also confidential and is kept in secure storage.
The Ten National Privacy Principles and how they relate to our
Service
1. Collection
When we collect personal information from you, it will be for a purpose
that is clearly expressed to you, and only information that is necessary
for one of our functions or activities will be collected. When you
are asked to disclose personal information, or when we gather personal
information
from you verbally, you will be told our organisation’s name,
the purpose of collection, the situations in which you can access
the personal
information, to whom this information will be disclosed, and the
effect on our advice if you do not give the information.
2. Use and Disclosure
We will only use or disclose personal information for the purpose for
which it was collected. Before any other disclosure is made, your approval
will be gained.

All personal information is securely stored (lockable filing cabinets,
alarmed premise) whilst in use in our office. Once the file is closed,
it will be stored in secure storage and scheduled for destruction in
seven years.

These documents are accessible to staff and clients. On request, we
will always take reasonable steps to let a person know what type of personal
information we hold, for what purposes we hold it, and how we collect,
hold, use and disclose that information.
6. Access and Correction
Central Community Legal Service will give you access to personal information
that we hold you, where it is possible in law and ethics. Where applicable,
requests will be acknowledged in writing and fulfilled in the most appropriate
form within 30 days. In some situations, it may be necessary to withhold
information that has been requested.
7. Identifiers
When implementing its own identification system, Central
Community Legal Service will not adopt, use or disclose an identifier
(number, letters,
code) that has been assigned to a person by a Commonwealth government ‘agency’.
Exceptions include where such a use or disclosure is necessary to fulfil
an obligation to a government agency.
8. Anonymity
In some cases, there may be opportunity for the client to interact with
our services anonymously. This will be judged on a case by case basis,
and the services that we provide may be limited.
9. Transborder Flow of Data
We will only transfer personal information to a recipient in a foreign
country in circumstances where we have gained your consent and the information
has the appropriate protection.
10. Sensitive Information
We will not collect sensitive information unless you have given consent,
it is required by law, or it is necessary for us to provide our service
to you.
National Information Scheme
When you first come to our service for information, we will ask you
some questions for the National Information Scheme (NIS). This is a Federal
Government initiative to collect information relating to the people assisted
by Community Legal Services around Australia.
No identifying information will be used, only statistical information.
The Privacy Policy
All personal information gathered by Central Community Legal Service
will be collected, maintained, used, stored and disposed of in accordance
with the Privacy Act 1989, the Privacy Act Amendment 2000, and the ten
National Privacy Principles as set out by the Privacy Commissioner.
The UnitingCare Wesley Adelaide Privacy Policy outlines the
ways in which we ensure that the Privacy Principles are understood and
adhered to in daily organisational activities.
UnitingCare Wesley Adelaide’s Privacy Policy explains
our position in handling personal information. The policy is available
on the Internet, intranet and in the UnitingCare Wesley Adelaide
Policy Manual. Just ask us if you want to see a copy.
Privacy Officers
A Privacy Officer is responsible for ensuring compliance with the Privacy
policies and procedures where personal information is collected.
Privacy Officers are required to conduct annual privacy audits in order
to ensure compliance with Privacy Legislation.
Accessing Information, Reporting Changes and Lodging Complaints
Clients of Central Community Legal Service can access their personal
information, request a change to some of their details be made, or report
any privacy breach, by either communicating in person to a staff member
or via correspondence to the privacy officer. In either case, the privacy
officer will investigate and record the request and undertake any follow
up that is required.
